Prior Express Written Consent (“PEWC”)
PEWC stands for Prior Express Written Consent, as defined by the TCPA (requiring specific disclosure language and opt in). See Section III for examples. PEC stands for prior express consent, such as when Vendor directly obtains permission from the consumer to be contacted by phone.
The TCPA requires that Prior Express Written Consent Evaluation. TCPA requires telemarketers to obtain PEWC of the called party before placing an outbound telemarketing call made by an ATDS to a wireless phone number. This next section will help you ensure Vendor has adequate PEWC.
Under the federal rules, an established business relationship (EBR) is a relationship between the company and the called party (e.g., the consumer) based on either: (A) consumer’s purchase, rental, or lease of the company’s products or services, or a financial transaction, within 18 months preceding the call; or (B) the consumer’s inquiry about the company’s products or services within three months prior to the date of the call. Some states have shorter EBR periods.
